Standing Chapter 13 Trustee for Baltimore Division and Maryland's Eastern Shore

Brian A. Tucci was appointed as Chapter 13 Trustee effective April 1, 2022. Chapter 13 trustees are appointed by the United States Trustee, which is part of the United States Department of Justice.

Chapter 13 trustees have an office and staff who work with them to administer Chapter 13 bankruptcy cases. The trustee’s office collects money as provided by a payment plan filed by debtors and approved by the bankruptcy court, and oversees the administrative aspects of a Chapter 13 case, including conducting the meeting of creditors and attending hearings before the Bankruptcy Court.

The trustee is a neutral party and does not represent the debtor or creditors. As a result, the trustee and employees of the Chapter 13 office cannot give legal advice to any party.

Chapter 13 trustee offices are self-sustaining operations and do not receive a Congressional budget allocation. Rather, operations are funded by a fixed percentage fee collected from all payments received by the trustee. 28 U.S.C. § 586(e)(2).

There are currently three Chapter 13 Trustees in Maryland. Brian handles Baltimore Division, consisting of Maryland's northern tier and eastern counties, as well as all counties on Maryland's Eastern Shore.
